1. Acceptance of Terms

By engaging PlantifyYards Gardening Services ("PlantifyYards," "we," "us," or "our") for gardening and landscaping services, you ("Client," "you," or "your") agree to be bound by these Terms and Conditions. These terms constitute a legally binding agreement between you and PlantifyYards.

2. Services Provided

PlantifyYards provides professional gardening and landscaping services including but not limited to:

• Lawn care and maintenance services
• Custom garden design and landscaping
• Seasonal planting and plant care
• Landscape maintenance and upkeep
• Irrigation system installation and maintenance
• Tree and shrub care services

3. Service Agreements

All services are subject to a written agreement specifying:

• Scope of work and project specifications
• Timeline for completion
• Total cost and payment terms
• Materials and plants to be provided
• Maintenance requirements and warranties

Any changes to the original agreement must be documented in writing and agreed upon by both parties.

4. Payment Terms

Payment terms are as follows:

• Deposits may be required for larger projects before work begins
• Payment schedules will be outlined in individual service agreements
• Final payment is due within 30 days of project completion
• Late payments may incur additional charges as specified in the service agreement
• We accept cash, check, and major credit cards as payment methods

5. Client Responsibilities

As our client, you agree to:

• Provide accurate information about your property and preferences
• Ensure safe and reasonable access to work areas
• Notify us of any underground utilities, sprinkler systems, or hazards
• Secure pets and remove obstacles from work areas
• Follow care instructions for newly installed plants and features
• Make timely payments according to the agreed schedule

6. Warranties and Plant Guarantees

We provide the following warranties:

• 90-day warranty on newly installed plants (with proper care)
• 1-year warranty on hardscape installations
• 30-day warranty on lawn seeding and sodding
• Warranties are void if proper care instructions are not followed
• Natural disasters, extreme weather, and pest damage are not covered

7. Limitation of Liability

PlantifyYards's liability is limited as follows:

• Our total liability shall not exceed the contract value for the specific project
• We are not responsible for existing conditions not disclosed by the client
• Weather-related delays are beyond our control and may affect timelines
• We carry appropriate insurance but recommend clients verify their own coverage

8. Cancellation Policy

Service cancellations are subject to the following terms:

• Scheduled maintenance visits can be canceled with 24-hour notice
• Project cancellations may be subject to cancellation fees
• Materials ordered specifically for your project may not be returnable
• Work already completed will be billed according to the agreed rates

9. Weather and Seasonal Considerations

Our services are subject to weather and seasonal conditions:

• Work may be delayed or rescheduled due to inclement weather
• Seasonal availability of plants and materials may affect project timelines
• Winter services may be limited based on local climate conditions
• Emergency weather-related damage cleanup is available at premium rates

10. Property Damage

While we take every precaution to protect your property:

• Existing damage should be noted before work begins
• We will repair or compensate for damage caused by our negligence
• Underground utilities should be marked before excavation work
• Clients are responsible for damage to unmarked utilities

11. Intellectual Property

Design work and concepts remain the intellectual property of PlantifyYards until payment is made in full. Clients may not reproduce or modify designs without written permission.

12. Dispute Resolution

Any disputes arising from these terms or our services will be resolved through:

• Good faith negotiation between the parties
• Mediation if direct negotiation is unsuccessful
• Binding arbitration as a final resort
• Legal proceedings in the jurisdiction where services were provided

13. Modifications to Terms

These terms may be updated periodically to reflect changes in our business practices or legal requirements. Current terms will always be available on our website, and significant changes will be communicated to existing clients.
